Terms of service

By using PrakIt you accept the terms below.

These Terms of Service (the "Terms") govern your access to and use of the PrakIt mobile application, the website www.prakit.be and any related features (together, the "Services") published by Conceptzone SRL, with registered office at Avenue Henri Houssaye 27, Waterloo, Wallonia 1410, Belgium ("Conceptzone", we, our).

In short: PrakIt is a digital logbook for Belgian learner drivers. It does not replace the Highway Code, driving-school instruction, or the supervisor's judgement. By using PrakIt you accept these Terms and our Privacy Policy.

Road safety warning

Use of PrakIt while driving is strictly limited. The Learner must never operate the phone or interact with the application while driving. Only the Supervisor, as a passenger, may interact with the application, and only when this can be done without compromising the safety of the vehicle's occupants or other road users. Conceptzone disclaims all liability for accidents, offences, or damages resulting from use that breaches this warning.

1. Acceptance of these Terms

By creating an account, downloading the PrakIt application or otherwise using the Services, you acknowledge that you have read these Terms and agree to be bound by them. If you do not accept any clause, you must refrain from using the Services.

These Terms form a legally binding contract between you and Conceptzone. They apply to every version of the Services, including their updates, evolutions and new features.

2. Definitions

  • Learner: the natural person holding a Belgian provisional driving licence (model M3, M18 or M36) who is learning to drive and uses PrakIt to record practice hours.
  • Supervisor: the natural person who meets the Belgian legal conditions to accompany a Learner (in particular the Royal Decree of 10 July 2006 on driving licences and its regional implementing orders).
  • Account: the personal space created by the User on PrakIt.
  • Session: a driving trip recorded in PrakIt, together with the associated GPS data, timestamps and notes.
  • User Content: any data you upload to or generate through the Services (comments, notes, ratings, reports, etc.).
  • Subscription: a paid plan granting access to premium features (Pro, Family).

3. Description of the Services

PrakIt is a digital logbook designed to help Belgian learner drivers maintain the legal record of their practice hours. The Services include, in particular: GPS recording of Sessions, generation of regional roadbook PDFs (SPW Mobilité, MOW, Brussels Mobility), AI-assisted educational summaries and feedback, management of Learner / Supervisor relationships, and competency tracking.

PrakIt is NOT:

  • a navigation app or a road GPS;
  • a substitute for the Highway Code, road signage or instruction provided by an accredited driving school;
  • a guarantee of passing the practical driving exam;
  • an official certificate of driving ability. Only accredited examiners may issue one.

4. Road safety: use while driving

In short: PrakIt is used while the vehicle is stationary or by the Supervisor as a passenger. Any interaction with the application is forbidden to the Learner while driving.

4.1. The Learner must never, under any circumstance, operate their phone or interact with PrakIt while in effective control of the vehicle. Starting and stopping a Session, any note input, and any consultation of information must occur with the vehicle stopped or be performed by the Supervisor as a passenger.

4.2.The Supervisor must only interact with the application when doing so does not compromise their attention, the safety of the vehicle's occupants, or the safety of other road users.

4.3. Information displayed by PrakIt (speed limits, route suggestions, AI feedback, markers and any data derived from GPS or Mapbox) is provided for informational purposes only. It may be incomplete, incorrect or delayed. The Belgian Highway Code, road signage in place, and the instructions of competent authorities prevail in all circumstances.

4.4. The User expressly acknowledges that any breach of article 4 constitutes a violation of these Terms and a misuse of the Services. Conceptzone disclaims all liability for the consequences of such breach, including (without limitation) any accident, traffic offence, material or bodily damage, or administrative sanction.

5. Eligibility

To create an Account, you must: (i) meet the minimum legal age required in Belgium to undertake driving training (generally 17 for the free track, 18 for the driving-school track); (ii) if you are a minor, obtain the prior consent of your legal representative, who is deemed co-holder of the Account; and (iii) reside in Belgium or be undertaking your driving training there.

Conceptzone reserves the right to refuse, suspend or remove any Account that does not meet these conditions.

6. Account creation and security

You agree to provide accurate, complete and up-to-date information when creating your Account, and to keep it current. Only one Account per person is allowed.

You are solely responsible for the confidentiality of your credentials and for any activity performed from your Account. You must notify Conceptzone without delay at ulric.lonfils@conceptzone.be in the event of unauthorised use of your Account or any breach of its security.

7. User obligations

You undertake in particular to:

  • comply with the Belgian Highway Code and any other applicable regulations during every Session;
  • not falsify a Session, not record a trip that you did not actually undertake, not attribute a Session to a Learner or Supervisor who did not participate;
  • comply with any time-of-day restrictions applicable to learner tracks (for example, the prohibition on driving between 22:00 on Friday and 06:00 on Monday on the free track in some Regions);
  • not use the Services for unlawful, fraudulent or harmful purposes;
  • not attempt to circumvent, disassemble, decompile or otherwise exploit the Services or their technical components without authorisation;
  • not upload unlawful, defamatory, infringing or third-party-rights violating content;
  • not impersonate any person, nor share your Account.

8. Role of the Supervisor

The Supervisor is solely and fully responsible for: (a) compliance with the legal conditions allowing them to accompany a Learner (valid driving licence, seniority, criminal record requirements, etc.); (b) the compliance of completed Sessions with Belgian regulations; and (c) the validation of Sessions recorded in PrakIt.

PrakIt provides tools for the Supervisor to record and validate Sessions, but does not replace the driving school, the examiner or the competent regional authority. Validating a Session within PrakIt does not amount to an official certification of driving ability.

9. Subscriptions, payment and right of withdrawal

The Services are offered under several plans: a free plan (Free) and paid plans (Pro, Family). The features, scope and pricing of each plan are described at www.prakit.be/en/pricing/.

9.1. Payment methods. Subscriptions taken out through the mobile application are billed and collected by Apple (App Store) or Google (Google Play) under their respective terms. Subscriptions taken out through www.prakit.be are processed by Stripe (notably via Bancontact).

9.2. Automatic renewal. Unless stated otherwise, Subscriptions renew automatically for successive identical periods. You may turn auto-renewal off at any time in your Apple, Google or prakit.be account settings, at least 24 hours before the end of the current period.

9.3. Right of withdrawal. In accordance with article VI.53, 13° of the Belgian Code of Economic Law, you expressly acknowledge that, for contracts for the supply of digital content not delivered on a tangible medium, you lose your 14-day right of withdrawal as soon as the Service starts with your prior express consent and your acknowledgement that you lose your right of withdrawal. By activating paid features immediately after purchase, you request immediate performance of the Service and accept the loss of your right of withdrawal.

9.4. Refunds. Refund requests for Subscriptions taken out via Apple or Google are governed exclusively by their respective policies and must be addressed to them. For Subscriptions taken out via www.prakit.be, address your request to ulric.lonfils@conceptzone.be. No refund is due where the right of withdrawal has been lost (article 9.3).

9.5. Price changes. Conceptzone may change its prices. Any change applicable to an ongoing Subscription will be notified to you at least 30 days before it takes effect and will apply only to the next renewal period. You may cancel your Subscription before that date if you do not accept the new pricing.

10. Free and paid features

Some features are reserved for paying subscribers, in particular the real-time speed-limit head-up display (Mapbox HUD), in-depth AI analyses, multi-learner accounts and the tools for driving schools. A detailed feature breakdown per plan is available on the Pricing page.

Conceptzone reserves the right to evolve, add or remove features. Any material change that removes a core feature from a paid plan will give rise, as the case may be, to a credit, a pro-rata refund, or a fee-free termination at your initiative.

11. Artificial intelligence features

The Services include analysis and educational-feedback features generated by artificial intelligence models provided by third-party suppliers (in particular Anthropic). Content produced by these features is provided for informational and educational purposes only. It does not constitute legal advice, medical advice, a certification of your driving level, or any guarantee of passing the exam.

Outputs of an artificial intelligence model may contain errors, omissions or biases. You remain the sole judge of whether to act on this information and acknowledge that Conceptzone cannot be held liable for a decision made based on AI feedback.

12. PDF roadbook: no guarantee of acceptance

PrakIt generates roadbook PDFs designed to mirror the templates published by the competent regional authorities (SPW Mobilité for Wallonia, MOW for Flanders, Brussels Mobility for the Brussels-Capital Region). Conceptzone uses reasonable efforts to keep these templates up to date.

However, Conceptzone does not guarantee that the generated PDF will be accepted by the competent regional authority, by an examiner or by any other third party. The Learner and their legal representative remain solely responsible for verifying that their roadbook is complete, accurate and compliant with applicable requirements, and for completing any additional steps that may be required (handwritten signature, driving-school validation, etc.).

13. User Content

You retain ownership of the User Content that you upload to or generate through the Services. You grant Conceptzone a non-exclusive, royalty-free, worldwide licence, limited in scope to operating the Services (hosting, processing, anonymised statistical aggregation, PDF generation, feeding strictly necessary AI features).

You warrant that you hold all rights necessary to make the User Content available and that such content does not infringe any third-party rights or any legal provision.

14. Intellectual property

The PrakIt brand, the logo, the prakit.be domain name, the application, its source code, its interfaces, its databases and all elements making up the Services are the exclusive property of Conceptzone or its licensors and are protected by Belgian and international intellectual property laws.

Conceptzone grants you a personal, non-exclusive, non-transferable and revocable licence to use the Services, limited to personal, non-commercial use in accordance with these Terms. Any other use is prohibited without prior written authorisation.

15. Service availability

Conceptzone uses commercially reasonable efforts to keep the Services available. However, the Services are provided "as-is" and "as-available", without any service-level commitment (SLA). Occasional interruptions, maintenance windows or failures may occur.

16. Limitation of liability

In short: Conceptzone's liability is capped to the extent permitted by law. The limitations below do not apply where Belgian law prohibits any exclusion or limitation.

16.1.Nothing in these Terms excludes or limits Conceptzone's liability for (i) fraud, (ii) gross negligence, (iii) bodily injury or death resulting from Conceptzone's negligence, or (iv) any other liability that applicable Belgian law prohibits excluding or limiting, including the mandatory rights granted to consumers.

16.2.Subject to article 16.1, Conceptzone's total and aggregate liability to you, on any and all heads of damages combined, under or in connection with the Services or these Terms, is capped at the higher of: (a) one hundred euros (€100), or (b) the total amounts actually paid by you to Conceptzone in respect of your Subscription during the twelve (12) months preceding the event giving rise to the damage.

16.3. Under the same reservation, Conceptzone cannot be held liable for any indirect damage, loss of operations, loss of opportunity, loss of data, loss of profit, loss of reputation, or any third-party claim, whether foreseeable or not. The User acknowledges that it is their responsibility to back up their roadbook regularly, in particular via the PDF export feature.

16.4. Conceptzone shall under no circumstances be held liable for a traffic accident, traffic offence or sanction suffered by the User or by a third party, including where such events occur on the occasion of using the Services. The driving obligations remain those of the Learner and of the Supervisor.

17. Indemnification

You agree to indemnify and hold Conceptzone, its directors, employees and subcontractors harmless from any claim, action, loss or damage (including reasonable defence costs) arising from: (i) your breach of these Terms, in particular of article 4 (Road safety); (ii) your Content; (iii) any use of the Services contrary to their intended purpose.

18. Suspension and termination

18.1. You may delete your Account at any time from the application settings or by writing to ulric.lonfils@conceptzone.be. Deletion results in the loss of the associated data on the terms described in our Privacy Policy.

18.2. Conceptzone may suspend or terminate your Account, without notice and without compensation, in the event of a serious or repeated breach of these Terms, fraud, abuse, Service-security harm, or upon requisition from a competent authority.

19. Personal data protection

The processing of personal data carried out in connection with the Services is described in our Privacy Policy. The use of cookies and similar technologies is detailed in our Cookie Policy.

20. Changes to the Terms

Conceptzone may amend these Terms at any time. Any material change will be notified to you by email or via the application, at least 30 days before it takes effect. Failing termination of your Account before that date, you will be deemed to have accepted the new version. The last-updated date appears at the top of these Terms.

21. Force majeure

Conceptzone cannot be held liable for a failure resulting from a case of force majeure or an event beyond its reasonable control, including (without limitation): natural disasters, armed conflicts, industrial action, supplier failure (cloud, telecom, payment, mapping), governmental decisions, or pandemic.

22. Severability

If a clause of these Terms is held void, invalid or unenforceable by a competent court, the remaining clauses remain in force. The offending clause will be replaced by a valid clause of equivalent economic effect.

23. Governing law and jurisdiction

These Terms are governed by Belgian law. Any dispute relating to their formation, interpretation, performance or termination will be brought before the competent courts of the Walloon Brabant judicial district (Belgium), without prejudice to the mandatory rules applicable to consumers.

If you reside in another European Union member state, you enjoy the protection of the mandatory provisions of your country of residence and you may also bring proceedings before the courts of your country.

In the event of a dispute, the European Commission provides an online dispute-resolution platform accessible at https://ec.europa.eu/consumers/odr.

24. Beta status and test users

In short: If you access the Services as part of a test program (TestFlight, Google Play internal, closed or open testing, or any similar program), you are using a pre-release version. You accept the limitations and risks specific to that kind of use.

24.1. This article applies to any person taking part in a test program for the Services, whether internal, closed or open testing via Apple TestFlight, the Google Play Console, or any other early-distribution channel.

24.2. You acknowledge that the application is under active development and constitutes a pre-release. Features may be unstable, incomplete, modified or temporarily unavailable without notice. Data may be lost during a version migration or following the reset of a test environment.

24.3. No guarantee is given as to the stability, performance or availability of pre-release versions. Articles 15 (Service availability) and 16 (Limitation of liability) apply in full, with the understanding that the level of risk accepted by a test user is greater than that for a stable release.

24.4. The Learner and the Supervisor remain bound at all times by article 4 (Road safety). The PDF roadbook generated by a pre-release version may not yet comply with the requirements of regional authorities (see article 12): you must not rely on a pre-release version for official submissions to the SPW, the MOW, Brussels Mobility or any other authority.

24.5. You agree, on our request, to provide constructive feedback and to report any anomalies you encounter, through the channels indicated (for example an in-app form, the address ulric.lonfils@conceptzone.be or the feedback tools provided by Apple / Google).

24.6. You agree not to share publicly (social networks, press, online videos, etc.) any screenshots, videos or descriptions of features that have not yet been officially released, without our prior written consent.

24.7. You acknowledge that the prices, subscription plans, packages and features displayed during a test phase are indicative and may change before the public release of the Services.

24.8. Conceptzone may end your participation in a test program at any time, without notice or compensation, and may delete or reset at any time the data associated with your test Account.
